Employment-Based Immigration: very First Preference EB-1
You may be qualified for an employment-based, first-preference visa if you are an alien of extraordinary ability, are an impressive professor or scientist, or are a specific multinational executive or supervisor. Each occupational classification has certain requirements that should be met:
Your petitioning company needs to be a U.S. employer and plan to use you in a supervisory or employment executive capacity. The petitioner should have been doing service in the U.S. for a minimum of 1 year, as a legal entity with a qualifying relationship to the entity that used you abroad in a supervisory or executive capacity.
No labor certification is needed.
* Criteria for Demonstrating Extraordinary Ability
In order to show you have actually sustained nationwide or international recognition which your achievements have been recognized in your field of knowledge, you should either consist of proof of a one-time accomplishment (significant internationally-recognized award) or 3 of the 10 listed criteria below (or comparable proof if any of the criteria do not easily use):
– Evidence of invoice of lesser nationally or worldwide recognized prizes or awards for excellence
– Evidence of your subscription in associations in the field which require impressive accomplishment of their members
– Evidence of released about you in professional or significant trade publications or other major media
– Evidence that you have been asked to evaluate the work of others, either separately or on a panel

– Evidence that your work has been displayed at creative exhibits or displays

– Evidence that you command employment a high income or other significantly high remuneration in relation to others in the field
– Evidence of your industrial successes in the performing arts

** Examples of Documentary Evidence That a Person is an Exceptional Professor or Researcher
In order to demonstrate you are an exceptional teacher or researcher, you must consist of proof of 2 of the 6 listed requirements below (or comparable proof if any of the requirements do not easily use):
– Evidence of invoice of significant rewards or awards for outstanding accomplishment
– Evidence of subscription in associations that require their members to demonstrate impressive accomplishment
– Evidence of published product in expert publications composed by others about the alien’s work in the scholastic field
– Evidence of participation, either on a panel or individually, as a judge of the work of others in the exact same or allied scholastic field
– Evidence of original clinical or academic research contributions in the field

Application Process
Extraordinary Ability: You may get yourself by submitting a Type I-140, Petition for Alien Worker.
Outstanding Professors and Researchers: Your U.S. company should submit a Kind I-140, Petition for Alien Worker. As part of the application procedure, your employer must be able to show a continuing capability to pay the offered wage since the top priority date. Your employer might use a yearly report, federal tax return, or audited financial declaration to demonstrate a continuing ability to pay your wage.
Multinational Manager or Executive: Your U.S. employer should file USCIS Form I-140, Petition for Alien Worker. As part of the application process, your company should have the ability to demonstrate a continuing ability to pay the used wage as of the concern date.
