Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights include:- Spend for all earnings earned (INFO # 3) at the rate concurred to by the employer and worker.

– Pay of at least minimum wage (INFO # 1), the appropriate Colorado or regional base pay, and all earned overtime incomes without impermissible deductions from their salaries;.

Labor Statutes, Rules, & Published Guidance

Statutes & Rules: DLSS implements a lot of Colorado’s wage and hour and other types of labor statutes and labor rules, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Pay for Equal Work Act. Please go to the Division’s Labor Statutes and Labor Rules websites for present and previous variations of key Colorado labor statutes and guidelines.

Published Guidance: The Division’s main types of public guidance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s formally approved notifications, opinions, and explanations on numerous labor law subjects; and.

– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for staff members on their labor rights.

Written Demands, Complaints, & Investigations

Demands & Complaints for Wages: If an employer owes you earnings, you can send your employer a written demand for payment of incomes by mail, e-mail, text message, or other electronic means. A written demand might be sent out to the employer at the very same time a Labor Standards Complaint Form for unsettled salaries is filed with the Division. Employer Responses in Investigations: Once a complete Labor Standards Complaint Form is received and reviewed, a letter explaining the nature of the problem and the quantities alleged to be owed is sent out to the employer. Investigations Launched by the Division (” Direct Investigations”): The Division may perform employer-wide direct investigations of possible violations of Colorado wage and hour law. If you want to send a suggestion, please email the Division at cdle_di_tips@state.co.us. If you want to submit a private claim for unsettled salaries, you need to complete a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements webpage. To appeal a direct examination citation or several Notices of Assessment, a supposed employer might send a Direct Investigation Appeal Form.
